TERMS AND CONDITIONS OF SALE
1. GENERAL
1.1
The following conditions apply to all agreements entered into with Cend AB organisation number 556878-8631, hereinafter referred to as "canvasbutik.com" regarding the purchase and delivery of goods/goods from canvasbutik.com to EU buyers. Canvasbutik.com only enters into agreements with an adult (18 years) person.
1.2
Canvasbutik reserves the right to sell out of products and to correct any errors in image and text information on the website. This may include inaccurate product descriptions, technical specifications, pricing and price adjustments (such as changes in supplier prices or currency exchange) and inaccurate information about stock availability. Canvasbutik is fully authorised to correct such errors and update the information when necessary.
1.3
Should it happen that an incorrect price is given for a product you have ordered, Canvasbutik will of course inform you of this and wait for your consent before proceeding with the order. Please note that all image information on the website should be considered as illustrations only and cannot guarantee the exact appearance of the product. Canvasbutik cannot be held responsible for information provided by third parties on the website.
2. PAYMENT
2.1
Card payment: You can pay by Visa, Mastercard or American Express. Select card payment and follow the instructions. The goods will be dispatched immediately after payment and no additional fee will be charged. Card payments are processed by Klarna. Only cards activated with 3D Secure will work.
2.2
Invoice: We offer payment by invoice via our partner Klarna. When paying by invoice, the goods are sent to the registered address. If you do not want the goods to your registered address, we kindly ask you to use another payment option. There is no invoicing fee (SEK 0). Payment terms 30 days. In case of late payment, a reminder fee, penalty interest and the current reference interest rate will be charged.
2.3
Partial payment: We offer partial payment in cooperation with Klarna. You can pay the entire remaining debt at any time during the instalment period. The instalment options we offer are shown at checkout. For current conditions see the link below.
2.4
PayPal: You can pay with PayPal, select the option at the checkout and then follow the instructions. You will need a PayPal account to make the payment. If you do not have one, you can easily register one at the time of purchase. The goods will be dispatched immediately after payment and no additional fees will be charged.
2.5
Prepayment: Payment is made in advance and the order is activated once we have received payment. You will be provided with an invoice number and our bankgiro number. Then you pay in the same way as with a regular invoice. For example, via online banking. Pay your order on Bankgiro number 255-6363. Be sure to enter your order number in the "message" field (not OCR). Please note that the delivery time may be 2-4 days longer in case of prepayment.
2.6
Gift card: If you have received a gift card for canvasbutik.com, you can use it as a payment option by entering the code from the gift card during the ordering process.
3. OFFERS & PROMOTIONS
From time to time, Canvasbutik may offer promotions on its website that contain more favourable conditions than those described in these terms of use. These enhanced conditions are valid for the duration of the promotion and only for the specific products that Canvasbutik has identified in connection with the promotion. It is important to note that Canvasbutik reserves the right to cancel such promotions at any time. In case of termination or suspension of a campaign, these terms of use will continue to apply unchanged. Any offers on specific products on the website are limited in time and are valid while stocks last.
4. DELIVERY
4.1
After completing an order on canvasbutik.com, you will receive an order confirmation by e-mail where you can easily see all the details of your order such as delivery address, which paintings you have ordered and the total amount.
Paintings in stock are normally dispatched within 2-4 working days.
Paintings not in stock are normally dispatched within 3-5 weeks. Deviations may occur. However, we cannot guarantee that the paintings will arrive within the specified number of days as unforeseen delays may occur. If your order does not arrive within the specified time, you have the right to return the order at no extra cost or not to collect or receive the order.
Some products may have a slightly longer delivery time during peak seasons or high volumes. You will receive a delivery confirmation email when your order is dispatched from our warehouse. If you have not received this email within the delivery time that applies to the delivery method you have chosen, please contact our customer service.
4.2
HOME DELIVERY:
For the delivery option 'Home Delivery' we use UPS. These options may vary depending on the size of the parcel and where our carriers can offer this service.
Our carriers will notify you via SMS and suggest a time for delivery. With these delivery options, you have the opportunity to influence the execution of the delivery, whereby additional costs may arise. In cases where your choices may create additional costs, this will be clearly communicated in the carrier's interface and these are then handled as a business relationship between the recipient and the carrier.
To be able to deliver your order, you need to be prepared to show identification upon receipt of the order. If someone other than the recipient receives the delivery, you need to be prepared to show the recipient's ID as well. If delivery could not be carried out due to the recipient's absence/availability, the shipment is returned to the carrier's nearest terminal (UPS) or the nearest parcel agent, whereby the recipient is notified of the possibility of new delivery options. If the shipment cannot be delivered, the package will be returned to Canvasbutik and handled as a return order.
4.3
DELIVERY TO AGENTS:

Delivery time: 2-4 working days. Free for orders over 49 €. For orders under 49 € there is a 9.90 € shipping charge. The parcel will be sent to the nearest delivery point for collection. You will be notified of delivery by SMS and email when the parcel has arrived. We reserve the right for any delays by the shipping company.
If a shipment is not collected, there is a shipping, handling and administration fee of 39 €. Special order items will be charged full value plus shipping and return shipping. Paintings that are too large to be collected by an agent will be delivered to your door.
5. RISKS DURING TRANSPORT / ERRORS DURING DELIVERY / RETURN
5.1
We bear the transport risk from our warehouse to you (i.e. damaged or lost goods). You are responsible for the risk of any return to us. Should anything be wrong in your delivery, error or damage to an item, wrong item or wrong number of items, please contact our customer service. Canvasbutik is responsible for all costs including transport in the event of an approved complaint.
5.2
NOTE! Visible damage must be reported to the agent immediately upon receipt of the parcel.
5.3
In case of a return, you must contact our customer service to obtain a return number and a return note. It is your responsibility to ensure that the goods arrive in undamaged condition. Therefore, make sure that the product is well packaged, in the original packaging or equivalent. The return is not authorised until we have checked the item. Refunds are made as soon as an authorised return is received.
5.4
In the event of an unauthorised return, the product will be returned and shipping will be charged. Goods that are returned without a valid return number are returned to the customer and shipping is charged.
5.5
When cancelling paintings already started, there is a fee for cancellation, handling and administration 39 €.
5.6
Canvasbutik undertakes to always follow ARN (ARN.se) recommendations.
6. SHAPE & COLOUR REPRODUCTION
6.1
The oil paintings offered on Canvasbutik.com are unique hand-painted artworks, which means that there will never be two identical paintings. Therefore, there may be slight variations between the painting you receive and the one you have seen on your screen.
6.2
Any differences in the colour shades of the oil paintings and canvases can usually be attributed to the calibration of the screen, which can lead to the perception of new variations.
6.3
Please note that all orders go through rigorous quality control and are approved by our expert team at Canvasbutik.com before being dispatched to you.
7. RIGHT OF WITHDRAWAL
7.1
Within 14 days of your order, you can cancel your order and order a return shipping. A return shipping costs from 9.90 €. After ordering a return shipping label, it is sent digitally to your e-mail. Open purchase only applies to deliveries within the EU and not to special orders. Special orders are goods that are not in stock but are made to order.
7.2
Right of withdrawal does not apply to businesses.
7.3
After the product is returned, depending on the payment method you chose at the time of your order, you will be reimbursed as shown below:
Invoice: If you have chosen invoice as the payment method for your purchase, the invoice has been cancelled and you can completely disregard it. If you have already paid your invoice, you will receive a refund from Klarna, they will send an email to you where they request the account information they need to make the refund.
Card: If you have chosen card payment or direct payment as a payment method, you will receive a refund from Klarna, they will send you an email asking for the account details they need to make the refund.
7.4
Please note that the product must be wrapped and packed in its original packaging and that refunds can take up to 5 banking days depending on your bank.
7.5
For the return to be authorised, the products must be returned within 14 days.
8. RIGHT OF WITHDRAWAL
8.1
As a customer, you are always entitled to exercise your right of cancellation. Within 14 days of receiving your order, you can cancel your purchase and return your order. Orders are returned by purchasing a return slip. Orders must be returned within 14 days from the date the order was received.
8.2
The refund will be made without undue delay and in any case no later than 14 days from the date on which we received your notice of cancellation. However, we reserve the right to postpone the refund until we receive the goods back from you or until you send us proof that you have returned the goods, whichever comes first.
9. WARRANTY AND COMPLAINTS
9.1
- The right to complain is valid for three years.
- Defects in goods must be reported within two months of the discovery of the defect. The notification is made by e-mail to info@canvasbutik.com. The notification must state what the defect is and a picture must be attached.
- If the delivery is delayed and the delay is due to an obstacle beyond our control that we could not reasonably be expected to have anticipated at the time of purchase and the consequences of which we could not reasonably have avoided or overcome and results in a longer delivery than announced, you as a customer are always entitled to cancel your purchase without any costs or obligations. Other compensation is not paid. Complaints are made to info@canvasbutik.com together with the order number.
- If you have notified us of the defect within two months of discovering the defect, your complaint is always considered to have been made within a reasonable time. If the complaint is not made within a reasonable time from the time the defect was discovered, or should have been discovered, and at the latest within three years and two months from the time you received the goods, you lose the right to claim any penalties under the Consumer Sales Act.
9.2
Canvasbutik undertakes to always follow ARN (ARN, Box 174, 101 23 Stockholm. www.arn.se) recommendations. In the event of any disputes, you can also turn to Online Dispute Resolution (ODR), which means "online dispute resolution" and is an online platform run by the European Commission.
10. WARRANTY
10.1
Of course, all products purchased from canvasbutik come with a warranty. The warranty is valid for 6 months from the date of delivery.
If the customer invokes the warranty and it turns out that the defect is due to external damage and therefore not covered by the warranty, the customer is responsible for any repair costs. Our authorised staff will in the first instance determine whether the fault is due to an incorrectly produced product or external damage after the product has reached the customer. The customer is responsible for shipping costs if the customer invokes the warranty.
10.2
IF YOU RECEIVED A FAULTY OR BROKEN PRODUCT:
Send an email within 14 days to info@canvasbutik.com with the following instructions:
1. Your order number.
2. Describe why you want to complain about the product.
3. Attach a photo of the faulty product, if possible.
4. You want to exchange the item or get a refund.
5. Wait for a reply with possible authorisation and return instructions.
6. If your purchased product does not meet your expectations, please contact our customer service.
10.3
NOTE! Visible damage must be reported to the agent immediately upon receipt of the parcel.
10.4
Canvasbutik is responsible for shipping in case of wrong deliveries and authorised complaints.

11. COPYRIGHT IMAGES
When you upload an image, you confirm that you own the copyright to the image and/or have obtained permission from the copyright holder to modify the image. Canvasbutik.com does not own the rights to images uploaded and produced through our store.
12. OWN RESPONSIBILITIES AND OBLIGATIONS
12.1
The use of our services on canvasbutik.se in your name is your personal responsibility. It is strictly forbidden to share your password with anyone else. If you suspect that someone else may have gained access to your customer ID and password, or if this has actually happened, we urge you to change your password immediately or contact our Customer Service via info@canvasbutik.com.
12.2
Canvasbutik.com disclaims liability for any actions taken in your name, even if someone else has gained access to your password. We reserve the right to terminate your account upon reasonable suspicion of abuse, and we will notify you if such action is taken.
We encourage you to carefully check your order confirmation to ensure that the number of products, article numbers and sizes are correct in your order.
12.3
Orders that are not collected will be charged a fee of 29.9 € for shipping, return shipping and administrative costs.
12.4
Please note that Canvasbutik.com reserves the right to change the terms of use when necessary.
13. FORCE MAJEURE
Canvasbutik is not liable for delays arising from circumstances beyond our control, such as general labour disputes, extreme weather, war, fire, thunder, terrorist attacks, changes in government regulations, technical problems, failures in electricity supply, telecommunications or computer networks, or delays by subcontractors due to similar circumstances. These circumstances constitute valid grounds for exemption from liability and the avoidance of any legal penalties.
If such a situation occurs, Canvasbutik will inform you both at the beginning and at the end of the ongoing circumstance. If the situation lasts for more than two months, both you and Canvasbutik have the right to cancel the purchase immediately.
14. CHANGES TO THE GENERAL CONDITIONS
Canvasbutik reserves the right to revise these terms of use at any time. Any changes to the terms and conditions will be published on our website. The revised terms and conditions will take effect when you accept them (when making a new purchase or visiting the website), or alternatively after a period of 30 days from when Canvasbutik informs you of the changes. In order to be well informed of any changes to the terms and conditions, we recommend that you visit our website regularly.
15. APPLICABLE LAW AND DISPUTE RESOLUTIONS
15.1
In the event that a dispute cannot be resolved by mutual agreement with Canvasbutik's customer service, you as a customer can turn to ARN (Allmänna reklamationsnämnden). More detailed information about ARN is available at www.arn.se. Alternatively, you can submit your complaint directly online via the European Commission's platform for mediation in disputes, which can be found via the following link: http://ec.europa.eu/consumers/odr.
15.2
When you submit a complaint via this platform, your case will automatically be forwarded to the nationally responsible dispute resolution body. This dispute resolution body will then contact us and endeavour to resolve the dispute without necessarily involving a court. In the event of a dispute, Canvasbutik will follow the decision of ARN or the corresponding dispute resolution body. We look forward to helping resolve any disputes in a fair and co-operative manner.
16. COPYRIGHT
The website, including all its content, is owned by Canvasbutik or its licensors and is protected under intellectual property and marketing laws. This extensive protection means that elements such as trademarks, company names, product names, images, graphics, design, layout and information about products, services and all other content may not be copied or used in any way without the written authorisation of Canvasbutik.
